LEGAL NOTICE FOR ACTIVATION OF CELLULAR PLANS

1. Intermediary Status: Description: We act as an intermediary for the activation of mobile plans. The services are provided by the main network and not by our company directly.


2. Payment Management: Please note: Payments for plans are processed directly by the service provider, not by our company. We do not collect payments directly and do not have access to customer payment information.


3. Activations and Services: Responsibility: Package activation and associated services are performed by the main network. We facilitate the activation process as a franchisee, but all operations are performed by the service provider.


4. Fees and Terms: Transparency: Set-up fees may apply, in accordance with the service provider's terms. We will inform you of these fees, if applicable, before you complete your order.
5. Customer Support: Support: For any questions or issues regarding plans, including billing issues or services not provided, please contact the service provider directly. We are available to guide you through the process, but service-specific questions should be directed to the primary network. REFUND, PRICE PROTECTION, EXCHANGE AND WARRANTY:

PRODUCT AVAILABILITY

Prices and availability of products are subject to change without notice and are subject to stock availability. If any of the products ordered become out of stock after the transaction has been completed, we will notify you by email and the out-of-stock product will be removed from the order and the price of that product will be refunded to you. SecondCell disclaims any liability in the event of a stock shortage and for any damage that may result therefrom or caused by any delay in delivery.

PRICES AND SALES TAXES

The prices displayed on the Site are in Canadian dollars (CAD$), do not include taxes and may change without notice. The official amount of your order including taxes will be transmitted to you when you confirm your order placed on the Site.

PAYMENT AND DELIVERY

We only accept payments by credit cards issued in Canada by Visa™ and MasterCard™ and by Paypal.

Express shipping is free. Allow between 2 business days in Quebec and 3 business days in the rest of Canada before receiving your order. If your product requires more time due to availability, in this case, we will inform you by email of the possible delay. Business days exclude weekends and holidays. The same day of the order is excluded from the calculation of business days.

Upon receipt of your order, if you notice any damage due to transport, you must notify us the same day you receive the package, by phone 450-348-7862 or 1-844-644-CELL(2355) or by email at info@secondcell.ca. We will send you a return slip for the device that will be exchanged. No exceptions will be made for damage reported later than the day the package is received.

Please note that for orders with Affirm financing, an additional 48 hours of delay must be added before the package is shipped.

CONFIRMATION OF YOUR TRANSACTION

Within 15 days of the completion of any transaction on the Site, we will send you an order confirmation email that includes the total price of your order and detailed terms of the transaction. We reserve the right to cancel the transaction, without the obligation to provide a reason. If we cancel your transaction, a notice will be sent to you by email at the address provided. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. Generally, when we cancel a transaction, we will not charge your credit card for the amount. If we do, we will either refund the amount or issue a credit to your credit card.

REFUND :

We accept refunds for a total of 7 days from the date of purchase, less fees.

Order online:

If the order has not yet been shipped , we will issue a full refund, less the 3% fee we are charged when placing a web order.

If the order has already been shipped , we will issue a full refund, minus the 3% fee that we are charged when ordering online. We will also deduct the outbound/return shipping fee from the order total (These fees vary by region).

Purchase in store:

• When purchasing in store, the refund is in full.

Please note that in cases where the phone is defective, then in this case only SecondCell will assume the shipping costs for the return or exchange.

In all cases, we will provide you with a shipping slip to return the device to us.

Please note that accessories (tempered glass, protective case, headphones) are not refundable. 

We do not accept refunds if the product has physical or liquid damage or if the device is still signed in to an Apple ID, Google ID, or password. Buyer must pay return shipping costs if returned for any reason other than a defect. Returns must include all accessories included with the device and the original box in perfect condition.

EXCHANGE :

A device exchange is possible during the first 30 days, starting from the day you received the device, if you are not satisfied with the device received.

The exchange must be made for a device of equal or greater value. You will be responsible for the price difference between the two devices.

The product must be in the same condition it was originally in. Return shipping costs in the case of an exchange will be paid by the customer. You have 30 days from the date you receive the device to make your exchange request.

We do not accept refunds if the product has physical or liquid damage or if the device is still signed in to an Apple ID, Google ID, or password. Buyer must pay return shipping costs if returned for any reason other than a defect. Returns must include all accessories included with the device and the original box in perfect condition.

GUARANTEE :

In the event of a device defect, a device repair warranty is provided against device defects only. Physical or liquid damage is not covered under the 1-year warranty.

Please note that the battery is guaranteed for a total period of 6 months from the date of purchase.

Only defects that are not caused by the user are covered under our warranty policy. Any breakage caused by improper use of the phone is not guaranteed.

Shipping costs in the case of an exchange under the 1-year warranty will be paid by SecondCell. You have 1 year from the date of receipt of the device to make your warranty claim.

We guarantee a battery life of at least 8 hours without recharging, under normal use (This is equivalent to a battery with at least 80% of its original capacity). Otherwise, we will test and replace the battery if necessary.

PRICE DROP PROTECTION:

Our prices and promotions vary regularly depending on product availability and available inventory.

Our price protection policy applies from the moment of purchase and is valid for a total period of 7 days*

At the customer's request, a credit for the difference will be issued if within 7 days of ordering, the exact same model (Device Model, Color, Storage and Cosmetic Grade) is listed at a lower price.

PROTECTION OF COMPETITION PRICES:

Competitor price protection only applies before the transaction is completed on our online store. Simply fill out the form below and we will match the price! Price protection only applies if the exact same model (Device model, color, storage, cosmetic grade and the competitor's warranty duration and conditions) is at a lower price on a competitor's website before you complete your purchase at SecondCell. Private sales (Marketplace, Kijiji, Ebay, etc.) are excluded. If delivery to the competitor is not free or charging accessories are not included, they will be taken into account in the price protection calculation.

PROMOTIONAL CODES:

Some promo codes may be invalid during events (eg. Black Friday, Boxing day, etc.). The discount of these codes always applies to the regular price of the device.

ERRORS ON OUR SITE

Although we are very vigilant about the product data appearing on our Site, it may happen that display errors (price, description, etc.) slip in. SECONDCELL RESERVES THE RIGHT TO RECTIFY THESE ERRORS WITHOUT HAVING THE OBLIGATION TO DELIVER THE GOODS UNDER THE CONDITIONS DISPLAYED BY ERROR.
